This Consumer Health Data Privacy Policy is provided in accordance with the Washington My Health My Data Act (RCW 19.373). It describes how Acute Pain Therapies (“APT,” “we,” “us,” or “our”) collects, uses, and shares consumer health data through the Website. We do not sell consumer health data.

This Consumer Health Data Privacy Policy is a separate and distinct policy from our Website Privacy Policy and is made available via a separate link on our Website.

Consent

When required by applicable law, we will obtain your consent before collecting or sharing consumer health data for the purposes that require consent.

Submitting information through our Website forms is voluntary. If you choose to submit information through a form, we use that information to respond to your request and for the purposes described in this policy.   • Uploaded Medical Records and Files: Collected to process new-patient submissions, coordinate care, and process authorizations for the release of protected health information.
  • Sensitive Health Information Consents: Collected to document and process specific consents related to sensitive health information as required by applicable law.

All categories of consumer health data listed above may also be used to comply with legal obligations.

We do not collect, use, or share consumer health data for any purposes not disclosed in this policy.

Consumer health data is collected directly from individuals who voluntarily submit information through Website forms.

How We Share Consumer Health Data

With service providers (processors) acting on our behalf. Deletion Requests

If you request deletion, we will take reasonable steps to delete consumer health data from our active systems and to direct our service providers (processors), as applicable, to do the same, subject to legal, regulatory, professional, and security-related obligations. Certain information may be retained as necessary for compliance, security, fraud prevention, dispute resolution, or other lawful purposes. Information stored in backups may be deleted or overwritten in accordance with our retention and security practices.

We will verify your identity before processing your request using commercially reasonable methods and will respond within the time period required by applicable law.

Appeal Process

If we deny your request in whole or in part, we will provide a written explanation. You may appeal the decision by contacting us in writing. We will respond to your appeal within the time period required by applicable law. If your appeal is denied, we will provide information on how you may contact the Washington State Attorney General’s Office to file a complaint.

Geofencing

APT does not use geofencing technology in connection with the Website.
